Terms of Use
Last Updated: December 2024
The Basic Idea
ZapFile is a free service. Use it responsibly, don't break the law, and we're cool.
Here's the longer version because lawyers exist:
Using the Service
By using ZapFile, you agree to:
- Not use it for anything illegal
- Not share copyrighted content you don't have permission to share
- Not abuse the service (spam, DoS attacks, that kind of thing)
- Not try to hack or break the service
- Take responsibility for what you choose to share
Basically: be a decent human being.
What You're Responsible For
Your files: You're responsible for what you share. We don't monitor transfers (we literally can't), so it's on you to make sure you're not sharing anything illegal or that violates someone else's rights.
Who you share with: Once you share a room code, anyone with that code can access the transfer. Choose your recipients wisely.
Your connection: We facilitate the peer-to-peer connection, but we can't guarantee it'll work perfectly every time. Firewalls, network configurations, internet stability - lots of variables we don't control.
What We're Responsible For
We'll do our best to keep ZapFile running smoothly. But we're a free service with no guarantees:
- The service is provided "as is"
- We might have downtime occasionally
- Transfers might fail sometimes (network issues, browser incompatibilities, etc.)
- We're not liable if a transfer doesn't work or if data is lost
Translation: We'll try hard to make it work, but stuff happens.
Things We Can Do
We reserve the right to:
- Block specific room codes if they're being used for abuse
- Ban IP addresses that are abusing the service
- Modify or discontinue the service (hope we don't have to)
- Update these terms (we'll let you know if we make big changes)
Prohibited Uses
Don't use ZapFile to:
- Share malware, viruses, or other harmful code
- Distribute copyrighted content without permission
- Share illegal content (child exploitation material, etc.)
- Harass or threaten people
- Violate anyone's privacy
- Run automated systems that spam room creation
- Try to overload or attack our servers
If we find out you're doing any of this, we'll block you. We might also report serious violations to authorities.
Copyright and DMCA
We respect copyright. Since we don't store files, we can't remove infringing content from our servers (because it's not on our servers).
However, if you believe someone is using ZapFile to infringe your copyright, contact us at [email protected] with details. We can block specific room codes or take other action as appropriate.
See our DMCA Policy for more details.
Liability Limitations
This is the legally required part:
ZapFile is provided "as is" without warranties of any kind. We're not liable for:
- Failed transfers or lost data
- Damages resulting from use of the service
- Issues caused by third parties
- Downtime or service interruptions
- Content shared by users
Maximum liability for anything: the amount you paid us (which is zero, since it's free).
Termination
You can stop using ZapFile anytime. Just close the tab.
We can terminate your access if you violate these terms. Usually this means blocking your IP address from creating new rooms.
Privacy
How we handle data is covered in our Privacy Policy.
Short version: we don't store your files and collect minimal data.
Changes to Terms
We might update these terms occasionally. When we do, we'll update the date at the top and post a notice on the site.
Continued use after changes means you accept the new terms.
Governing Law
These terms are governed by [jurisdiction] law. Any disputes will be resolved in [jurisdiction] courts.
(We really hope it doesn't come to that though.)

Miscellaneous Legal Stuff
Entire Agreement: These terms, plus the Privacy Policy, are the whole agreement between us.
Severability: If part of these terms is unenforceable, the rest still applies.
No Waiver: If we don't enforce something once, doesn't mean we've given up that right.
Assignment: You can't transfer these terms to anyone. We can transfer them if the service changes hands.
